Estates & Probate
Estate Planning is a process an experienced attorney can guide you through in order to protect your assets from being lost, paying unnecessary taxes, nursing home expenses and probate fees. Someone you know and trust can be appointed to handle your affairs if you become disabled. We will fight to keep the court out of your medical decisions, and make sure your assets end up in the right hands. Don’t lose all the things you’ve been spending so many years building- a thorough estate plan can manage and distribute assets according to your wishes.
Probate is a court-supervised process for identifying and gathering a deceased person’s (decedent’s) assets, including:
- Paying Taxes
- Filing Claims
- Managing Expenses
- Distributing Assets
Florida law has three kinds of probate administration: Formal, Summary and Family, as well as a non-administrative process known as “Disposition of Personal Property Without Administration.” Probate is much needed to take care of all the financial and legal matters the decedent leaves behind. The state of Florida provides for all aspects of the process, but allows the decedent to make certain decisions by leaving a valid will.
